The following terms and conditions apply to the commissions service provided by Colette
Thomson, Artist to you, the Client.
Please read these Terms and Conditions carefully. Any commission or use of services implies
that you have read, understood and accepted these Terms and Conditions.
Commissions:
Each drawing is unique, and Colette Thomson, Artist does not replicate or sell prints of any
commission received unless specifically requested in writing by the Client. Colette Thomson,
Artist works with chalk pastels on high quality pastel card, using a clear, detailed
photograph/photographs that the Client provides. The drawings measure approx. 11x15 inches (approx. 21x31cm) and come with a mount, but not framed. Price is to be agreed prior to commencement of the commission, however as a base line price it will be £75 per animal. Multiple portraits of the same animal count as separate animals. Colette Thomson, Artist reserves the right to offer a discount for multiple animals, but this is not a given.
Privacy Policy:
Colette Thomson, Artist retains only that personal information necessary for the completion of the commission. This included email addresses, phone numbers and home address (if necessary for delivery of the finished product). Colette Thomson, Artist will take all reasonable steps to ensure all these Client details are secure and once the commission is completed, will be deleted from their records. Colette Thomson, Artist does not pass on any personal information about any Client to any company or persons.
Shipping and Delivery:
If the delivery address of the commission is within the following areas, the finished product will be hand delivered at a mutually agreed time/place and will be free of charge.
KY3 – Burntisland, Kinghorn, Aberdour
KY4 – Cowdenbeath, Hill of Beath, Crossgates, Kelty
KY5 – Lochgelly, Cardenden, Ballingry, Kinlassie
KY11 – Dunfermline, Rosyth, Dalgety Bay, Limekilns, Charlestown, Inverkeithing, North
Queensferry
KY12 – Dunfermline (centre, north and west)
All other areas will incur a P&P charge and send either via DPD or hand-delivered. Collection by
the Client can also be arranged by mutual agreement.
Acceptance:
It is not necessary for the Client to have signed any document for these terms and conditions to apply. If the Client commissions a portrait from Colette Thomson, Artist, then the Client will be deems to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Price Quotations:
Charges for service to be provided by Colette Thomson, Artist are defined in the price quotation the Client will receive upon request via email. Quotations are valid for a period of 30 days. Colette Thomson, Artist reserves the right to alter or refuse to honour a quotation after expiry of the 30 days.

Additional Expenses:
The Client agrees to reimburse, Colette Thomson, Artist for any addition expenses incurred for
the completion of the work. Examples of these instances would be postal charge, extra travel
expenses for delivery etc.
Photo Provision:
The Client will be required to provide suitable photographs for the commission work to be produced. The Client must have permission to use such photographs and it is their responsibility to not breach any copyright laws.
Artwork Progress:
Once work commences on a Client’s portrait, Colette Thomson, Artist will email photos of the proposed Artwork and an estimated completion date.
At this stage, alterations can be made to it’s design contents. Colette Thomson, Artist will not share progress photos to social media until the Client or intended recipient of the artwork has received the finished product. At that point, a photo of the
finished product will be posted to Colette Thomson, Artist’s social media and website. Once Artwork in completed, Colette Thomson, Artist will email the Client a digital photo of the finished portrait. At this state, only very minor adjustments can be made.
Copyright:
Colette Thomson, Artist retains the copyright to the artwork created from the Client’s
photograph(s). Colette Thomson, Artist will not reproduce the artwork and it’s usage will not be
allowed on any other website apart from Colette Thomson, Artist’s website and social media
pages, unless the Client give written permission to do so.
Colette Thomson, Artist, reserves the right to display the artwork on their website and social
media pages and in their portfolio. If a Client is unhappy about the artwork being displayed,
they must declare this upon placing the commission.
The Client retains ownership of the physical artwork, but must obtain permission from Colette
Thomson, Artist to share the artwork on social media and must credit Colette Thomson, Artist in
any postings. If the Client wishes to make any reproductions of the Artwork, this must be
arranged through Colette Thomson, Artist only at the Client’s expense.
Deposit:
Colette Thomson, Artist requires a 50% deposit from the Client to confirm a commission slot.
This deposit is non refundable.
Payments:
Invoices will be issued by Colette Thomson, Artist upon completion of the Artwork and all final
costs are to be paid before collection/delivery. Invoices will be sent via email. The Client will
also be require to provide a current postal address to receive hard copy invoices if needed.
Payment in full is due upon receipt of invoice and before delivery. Please note, unless
specifically agreed to by both parties prior to the issuance of an invoice, Colette Thomson, Artist
does not accept payment in part or via installments.
Colette Thomson, Artist accepts payment by the following methods (in order of preference);
• Bank Transfer
• Cash
• Paypal

Termination before completion of commission:
If the Client chooses to terminate the service of Colette Thomson, Artist, after agreeing a
commission arrangement but before the commissioned project is complete, Colette Thomson,
Artist reserves the right to retain any non-refundable deposits paid.
Should the Client cancel the commission agreement after the Artwork has been completed,
Colette Thomson, Artist reserves the right to charge up to 85% of the total projected costs. The
scale of the charge will be dependent on the discretion of Colette Thomson, Artist and the state
of the project at the time of cancellation.
If communication breaks down on the part of the Client for a period of 30 days (that is, the
Client fails to reply to any communication from Colette Thomson, Artist a warning email will be
issued. If no reply is received to this warning email, (and communication does not resume)
within a following period of 30 days, Colette Thomson, Artist reserves the right to terminate the
commission. In this event, all deposits paid will be retained by Colette Thomson, Artist and the
commission will be cancelled.
If the Client then wishes to continue the commission at a later date, they will be required to request a new project quotation, sign a new Commission Agreement and pay a further non-refundable deposit.
